Real-World Example: AI Firm Fined for Facial Recognition
A US company was accused of gathering images from social media platforms, including Facebook, to build a massive facial recognition database. The company’s system allowed law enforcement agencies to match images against this vast database without the consent of the individuals whose photos were used. The Information Commissioner’s Office (ICO) in the UK found that the company violated data protection laws by processing personal data in ways that were neither fair nor transparent.
Key issues raised by the ICO included:
- Lack of consent: The company collected publicly available data without informing individuals or obtaining their consent.
- Unlawful data retention: The company didn’t have processes in place to delete the data after use.
- Failure to meet GDPR standards: Biometric data, such as facial recognition, requires higher standards of protection under the GDPR, which the company failed to meet.
- Obstructing data rights: People who requested the deletion of their data were subjected to unnecessary hurdles, including requests for additional personal information.
As a result, the company faced a £17m fine, and its operations in the UK were suspended.
